1. GENERAL INFORMATION
Any order placed with Tenditalia S.p.A. – via Morosini 24 – 27029 Vigevano (Pavia) Italia, Tax Code / Commercial Register 03774890150 – VAT 01596750180 implies the application without restrictions of the General Terms and Conditions of Sale specified herein.
2. ORDERS
An order is considered received if transmitted via fax. However, an order transmitted by phone or by e-mail may also be accepted.
3. PRICE
The prices stated in our confirmation order are those in force at the time of delivery. The last pricelist cancels and supersedes any other previous pricelist.
4. DELIVERIES
Any order confirmation that is not disputed within eight days from receipt shall be interpreted as a full acceptance of all the terms and conditions printed or handwritten on it. Delivery terms shall be deemed to be approximate and will depend on the company’s organization; any delays in delivery with respect to the date specified shall not entitle to lodge claims for damages or penalties.
5. RECEIPT / RETURN OF PRODUCTS / GUARANTEE
Goods must be inspected upon delivery. Any discrepancy between the goods received and those listed in the shipping document shall be noted to the carrier with the indication that receipt is subject to acceptance and prompt notice shall be given to Tenditalia S.p.A. in that respect.
Any complaint must be reported to us before using the goods.
If Tenditalia S.p.A. recognizes that a material is defective, the relating warranty shall extend for two years after the delivery of said material; said warranty only implies the replacement of the defective material, without Tenditalia S.p.A. being liable for any costs incurred for the replacement of the material already applied.
No returns are accepted if the related products are returned due to an incorrect order. Any returns for reasons other than those above specified shall be previously authorized by Tenditalia S.p.A. in writing.
Any improper use or tampering with our products entails the lapse of the above warranty.
6. PAYMENT
Any delay in payments entails the immediate interruption of the fulfilment of orders on hand.
Payments must be made directly to Tenditalia S.p.A. or to its duly authorized representative.
Tenditalia S.p.A. shall maintain ownership of the goods until the same are paid in full.
7. JURISDICTION – APPLICABLE LAW
In case of dispute, the Pavia Courts will have exclusive jurisdiction.
